The Board of Supervisors held a meeting this week. Please see below for highlights. The next meeting will be Tuesday, October 20, 2015 at 9:30am in the Hall of Administration – 333 W. Santa Ana Blvd., Santa Ana 92701.

Board Updates

Board moves closer to bringing an ethics commission to voters
The Board of Supervisors will vote October 20 to place a ballot measure before voters in June to create an Ethics Commission charged with providing advice and civil enforcement of the County’s campaign reporting laws, gift ban and lobbyist registration.

The measure is the combined effort of longtime government watchdog Shirley Grindle and Board members, notably Supervisor Shawn Nelson, who offered earlier this year to assist in producing a draft campaign reform ordinance based on sound and supportable principles. Supervisor Michelle Steel voted against creating the commission.

The proposal would revise the current TINCUP ordinance (which stands for Time Is Now, Clean Up Politics), passed by voters in June 1978 and amended in 1992. Voters also would be asked as part of the ballot measure to create the Ethics Commission by ordinance, amend the County Charter to establish its authority and amend the Lobbyist Registration and Reporting Ordinance.

The commission would consist of five members selected by supervisors based on specific criteria, who would serve without pay. The commission would have oversight over the six countywide elected officials (Assessor, Auditor-Controller, Clerk-Recorder, District Attorney-Public Administrator, Sheriff-Coroner and Treasurer Tax-Collector), the five Board members and candidates for those offices.

The ballot measure also would supersede Measure E, passed by voters last year, which provided for civil enforcement of the County’s campaign and reporting laws by the state Fair Political Practices Commission. That authority also must be approved by the state Legislature, which so far has declined to do so.

The commission would be staffed by an Executive Director who would provide confidential advice to officeholders and candidates on the sometime confusing elements of campaign law.

County Counsel Leon Page is drafting the final language of the ballot measure for consideration at the October 20 Board meeting with Senior Assistant County Counsel Ann Fletcher and Senior Deputy County Counsels Angie Daftary and Jaqueline Guzman.

The proposed measure also includes recommendations from a committee staffed by a representative from each Board office that examined other municipal ethics commissions in California and took five weeks of testimony on recommendations for structuring ethics enforcement.

30-Day Comment Period for Kraemer Site Opens
The public has until October 30, 2015, to comment on a Draft Mitigated Negative Declaration before the Board of Supervisors considers finalizing the purchase of the property at 1000 N. Kraemer Place for use as an Emergency Temporary Shelter and Multi-Service Center to serve the homeless.

Review under the California Environmental Quality Act is required before the Board of Supervisors makes a final decision whether to purchase the property for use as a 200-bed shelter that would connect the homeless with a variety of government assistance programs.

The 30-day comment period opened October 1. Commenters are asked to submit written comments by 4:30 p.m. on October 30, 2015, to OC Public Works at the address below, either by postal mail or email. The comments should address the finding that the project would not have a significant adverse impact on the environment. Please provide any supplemental data or documentation relevant to the comments.

Board Extends Sheriff Communications Lease with Riverside
The Board of Supervisors unanimously extended an existing lease agreement with the County of Riverside at the Ortega Communications Facility in South Orange County. This extension now runs to 2045.

This agreement will allow continued coordination and reduce total costs by providing a single facility to serve both counties’ needs. For Riverside, this provides a presence at the site to accomplish radio coverage for public safety purposes along the Ortega highway and portions of Riverside County that are extremely difficult or impossible to cover from other communication sites. And, currently, Riverside does not share a connection with Orange County public safety communications.

The existing License requires Riverside County to pay the County of Orange $15,500 for the first year. This Amendment reduces the 5% minimum annual increase to a 3% minimum or CPI, whichever is greater. This request by Riverside is in line with comparable communication agreements with other government entities and is also within the range of fair market for housing equipment within the County’s communication facilities. If inflation increases above 3%, the County will be protected by the CPI adjustment.

This agreement is expected to get $17,601 in revenue to the County of Orange this fiscal year, totaling $839,155 over the 30-year term of the lease. Either party can terminate the lease at any time, providing 45 days prior written notice as a courtesy. A map of the facility is below.

Founders Day Parade
It was a full morning of fun, friends and family photos as Supervisor Nelson made the pre-parade rounds of the staging area at North Court as 150 entrants made ready for the return of the Fullerton Founder’s Day Parade 2015.

After a 22 year absence, Mayor Greg Sebourn was happy to see the return of the parade and partnership with the City of Fullerton and North Orange County Chamber of Commerce to coordinate the adventure along Harbor Blvd.

Surrounded by bands, cheerleaders, service organizations and sports teams from throughout Fullerton, Supervisor Nelson enjoyed the morning sun on the rear-deck of the Camaro driven by Policy Advisor Steve Spernak.

The parade was slow enough that the Supervisor was able to navigate his car to the crowds seated and standing along the route to talk, renew friendships and take fun-photos with neighbors who have enjoyed Shawn Nelson since his 8 years as Councilman and Mayor in Fullerton.

The parade concluded at Wilshire Blvd and the crowds worked their way to the town fair in the downtown plaza where entertainment, food, BBQ, vendors and craft beer and wine setups were enjoyed by thousands of early-morning attendees.

Special thanks were extended by the Supervisor to City Manager Joe Felz, operations director Hugo Curiel, Chief of Police Dan Hughes and Teresa Harvey, CEO of the North OC Chamber of Commerce who packaged the thousands of moving parts and personalities into a fantastic sun-drenched morning parade and cityhood party.

Supervisor Nelson presents State of the County to the Brea Rotary Club
Supervisor Nelson presented his State of the County PowerPoint last week at the Brea Rotary Club luncheon. Addressing Homelessness, the future of OC Animal Care Shelter, and the County budget were among some of the issues spoken by Supervisor Nelson. The audience was particularly interested in AB 109 (public safety realignment) and how it impacts our system. Lastly, one rotary member specifically was very pleased with the efforts by Supervisor Nelson in completing the OC Bridge crossings in North Orange County. The mission of Rotary is to provide service to others, promote integrity, and advance world understanding, goodwill, and peace through its friendships of business, professional, and community leaders. Top Prep Student-Athletes in 4th District
Supervisor Shawn Nelson is honored to begin his sixth season recognizing the outstanding athletic performances of student-athletes from the 27 high schools he represents as the Fourth District Supervisor.

The recipients are chosen from sports sections of local papers and coaches/parents who provide personal briefings to the Supervisor on the performance of their athletes.

Those athletes in 16 CIF sanctioned high school sports who deliver the finest standards in academic accomplishment or athletic performance are sent a letter by the Supervisor to encourage them personally to new heights of individual accomplishment, team-work, classroom and game time- management and the ethics of sportsmanship and fair play.

Homeless Forum
On Wednesday, September 30, approximately 600 Orange County residents gathered to discuss the potential site for a homeless shelter at 1000 N. Kraemer Place. Supervisor Nelson Staffer, Natalie Wieckert, attended along with other County Representatives and City Officials. Karen Roper with OC Community Services, Larry Haines with Mercy House and Anaheim Police Department successfully fielded questions from the public regarding the operational and safety plan, while Council Member Kris Murray of Anaheim mediated the discussion. There were approximately 100 speakers with questions and comments added to the official record for review. This item is projected to come back to the board in November and the public has until October 30, 2015, to comment on a Draft Mitigated Negative Declaration before the final decision will be made.

Kaiser Permanente Opens New Radiation Oncology Center
Kaiser Permanente celebrated the grand opening of their new Radiation Oncology Center located at the Anaheim Medical Center. Supervisor Nelson Staffer, Natalie Wieckert, joined Assemblywoman Young Kim in recognizing Kaiser Permanente on their newly built state of the art facility. This facility has the ability to offer the best service for those seeking necessary medical attention. Supervisor Nelson thanks Kaiser Permanente’s continued presence in the Fourth District and wishes them best in all future endeavors.

Supervisor’s Honor OCFA Legend Kris Concepcion
It was a bitter-sweet moment last week in the Tustin firehouse as 100 Firemen, friends and family honored the retirement of Battalion Chief Kris Concepcion.

After 24 years, the legendary Fireman, mentor and proud dad, said he’s had the greatest life anyone could ask for with his assignments that included fire-911 response, Homeland Security planning, Haz-Mat response training and operations along with his years as the face and voice of OCFA as their PIO, Public Information Officer.

Concepcion was the founding element of his proudest accomplishment in bringing together the Pipes and Drums ceremonial bagpipe team for OCFA. The team members donated countless hours and travel to provide the historic sounds and songs of their profession to thousands of appreciative citizens and Firemen around the nation.

Concepcion will take command of the Vacaville Fire Department and continue his career while raising 3 college-age girls and enjoying the wilds of northern California with his wife.

Policy Advisor Steve Spernak presented the proclamation to Concepcion on behalf of the Board of Supervisors with their thanks and appreciation for his 24 years of devoted service to the people of Orange County.

Supervisor Supports Komen National Cancer Project
Supervisor Shawn Nelson was honored to have his name and support delivered to the 18,000 women and organizations who participated in the Komen Breast Cancer Rallyheld at Fashion Island, Newport Beach, last weekend.

The Supervisor has made it his commitment to support the efforts of breast cancer education, prevention, research and recovery as his contribution to the women in his family and the thousands of women in the Fourth District and OC challenged with this medical diagnosis.

Policy Advisor Steve Spernak attended the pre-race reception, thanked Master of Ceremonies Ed Arnold, took photos for cancer survivors and their families with Race for the Cure banners in the background and thanked the host teams and sponsors for their work showcasing this issue on behalf of the Supervisor.

America Remembers 9-11 Tragedy at Fullerton Memorial
Every year since Sept. 11, 2001, OC Firefighter Scott Townley honors the 343 NY Firemen and 74 NYPD and Port Authority Police Officers with wooden crosses bearing each of their names on his front lawn in Fullerton.

Townley has also added 2, 985 of the 6-inch American flags to honor the civilians killed by terrorists that morning at the World Trade Towers , Pentagon and Pennsylvania crash sites.

Supervisor Nelson had Policy Advisor Steve Spernak present Townley with a certificate of appreciation on behalf of the people of OC to extend their thanks and patriotic support of this memorial gesture that Townley constructs on his Woods Ave. residence each September.
