Update

Ensuring jurisdictional compliance of Senate Bill 1383 was a top
priority in 2022. OCWR worked together with the County’s 34 cities,
jurisdictions, and waste haulers, updating franchise agreements,
passing mandatory organic waste management ordinances,
conducting capacity planning activities and establishing edible
food recovery contracts.

Legislation making an impact

Legislative activity continued to unfold throughout 2022. OCWR tracked 36
bills, of which 19 were signed into law. Key legislative highlights include:

AB 1857
Zero Waste
Transaction Act
of 2022

Repeals the provision authorizing the inclusion of not more than 10% of the
diversion through transformation and removes the diversion credit for
municipal solid waste incinerators and redefines incineration as disposal.

Imposes the sales ban on the thermostats of every manufacturer not
in compliance with the act. The bill requires manufacturers to provide
collection bins for out-of-service mercury-added thermostats.

Procurement
Targets

Establishes a phased approach for meeting recovered organic procurement
targets, 30% by 2023, 65% by 2024 and 100% by 2025. Cities have two
additional years to comply with the SB 1383 organic waste diversion
procurement requirements.

Prohibits producers of single-use, disposable packaging or single-use,
disposable food service ware products from offering for sale,
distributing, or importing in or into the state such packaging or
products that are manufactured by 2032, unless they are recyclable
or compostable.
